Terms of Service

1. Acceptance of Terms

By accessing or using Funstack ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. We may modify these terms at any time, and your continued use constitutes acceptance of the modified terms.

2. Description of Service

Funstack provides a cross-game progression system enabling players to earn XP and STACKS through gameplay and ad engagement. The Platform includes SDKs for game developers, player-facing features, subscriptions, and in-game economy tooling.

3. Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Platform. By using the Platform, you represent that you meet this requirement. Users between 13-18 should have parental consent.

4. Account Responsibilities

  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activities under your account
  • You must not share account access or transfer accounts
  • You must notify us immediately of any unauthorized access

5. XP and STACKS

XP and STACKS are platform utility values used for progression and in-game utility. Important considerations:

  • XP and STACKS have no guaranteed monetary value
  • Rewards must be earned through legitimate gameplay and ad engagement
  • We may update earning rates, sinks, and mechanics
  • Manipulation or exploitation of reward systems may result in account termination

6. Prohibited Activities

You agree not to:

  • Use bots, scripts, or automated tools to earn XP fraudulently
  • Exploit bugs or vulnerabilities in the Platform
  • Create multiple accounts to circumvent limits
  • Harass, abuse, or harm other users
  • Violate any applicable laws or regulations
  • Infringe intellectual property rights
  • Attempt to reverse engineer the Platform or SDKs

7. Game Developer Terms

Game developers using Funstack SDKs agree to additional terms including proper SDK integration, compliance with ad policies, and revenue sharing agreements. See the Support Center for details.

8. Intellectual Property

The Platform, including its code, design, and content, is owned by Funstack and protected by intellectual property laws. You retain ownership of your game assets and content, subject to their respective terms.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR SPECIFIC RESULTS. THIRD-PARTY PAYMENT, AD, AND DISTRIBUTION SERVICES MAY INVOLVE INHERENT RISKS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XP PLATFORM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

11. Termination

We may suspend or terminate your access to the Platform at any time for violation of these terms or for any reason at our discretion. Upon termination, your right to use the Platform ceases immediately.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
